Rules for Claiming HRA Exemption Under Section 10(13A)
House Rent Allowance (HRA) is paid by corporate employers to help offset rental housing costs. Under Section 10(13A) of the Income Tax Act, salaried employees can deduct rent payments from their taxable gross income when opting for the Old Tax Regime.
Your employer's payroll team requires formal rent receipts before issuing Part B of Form 16. Without valid receipts, employers withhold additional Tax Deducted at Source (TDS), treating the entire HRA component as taxable salary.
The Three HRA Calculation Caps
Your eligible tax exemption is the least of the following three legal limits:
| Cap Condition | Metro Cities (Mumbai, Delhi, Kolkata, Chennai) | Non-Metro Cities |
|---|---|---|
| 1. Actual HRA Received | Full HRA amount listed on salary slip | Full HRA amount listed on salary slip |
| 2. Percentage of Basic Salary | 50% of (Basic Salary + Dearness Allowance) | 40% of (Basic Salary + Dearness Allowance) |
| 3. Rent vs. Salary Threshold | Actual Rent Paid minus 10% of Basic Salary | Actual Rent Paid minus 10% of Basic Salary |
Mandatory Landlord PAN & Revenue Stamp Guidelines
- Landlord PAN Threshold: As per CBDT Circular No. 08/2013, if total annual rent paid exceeds ₹1,00,000 (approximately ₹8,334 per month), reporting the landlord's Permanent Account Number (PAN) is legally mandatory. If the landlord does not possess a PAN, a signed declaration using Form 60 must be provided.
- ₹1 Revenue Stamp Requirement: Under the Indian Stamp Act, 1899, a ₹1 revenue stamp is mandatory only if rent exceeding ₹5,000 is paid in Cash per receipt. If rent is settled via UPI, NEFT, RTGS, or crossed bank cheque, a physical revenue stamp is not required because digital bank statements provide audit trails.
Frequently Asked Questions (FAQ)
Can I claim HRA if I pay rent to my parents?
Yes. You can pay rent to your parents and claim HRA deductions, provided your parents are the registered owners of the property, you transfer the rent via banking channels, and your parents declare the rental earnings in their annual Income Tax Returns (ITR).
Can I claim HRA by paying rent to my spouse?
No. Under Indian tax law, a husband and wife cannot maintain a commercial landlord-tenant relationship while living together in the same house.
Is HRA exemption available under the New Tax Regime?
No. Section 115BAC (the Default New Tax Regime) offers lower tax slab rates but eliminates itemized allowances including HRA, LTA, and Section 80C deductions. HRA exemption is exclusively available under the Old Tax Regime.
How many rent receipts do I need to submit to HR?
Most corporate payroll portals ask for either 12 monthly receipts or 4 quarterly receipts covering the April to March assessment period. SheetBox generates either format with a single click.
